I was not surprised to find out that there are more states that still perform the death penalty then those that do not.
there are 31 states that still perform the death penalty.

I was searching other sites as another source but i could only find this site. The rest of the sites that came up were Yahoo questions from other people asking the same thing which led me in circle.

Some States which technically still have the death penalty on the law books have not actually put a prisoner to death in many years. For example, my home state of California hasn't executed anyone for the last 9 years and, a year ago this month, a federal judge of the United States District Court ruled that California's death penalty system is "unconstitutional because it is arbitrary and plagued with delay." This decision was made because the way that the death penalty was carried out in California amounted to "cruel and unusual punishment" which is banned by the 8th amendment to the Constitution.
